1. Acceptance of Terms
Welcome to Pawmony. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Pawmony ("we," "our," or "us") governing your use of the Pawmony mobile application (the "App") and all related services.
By downloading, installing, creating an account, or otherwise using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not download, install, or use the App.
We reserve the right to update these Terms at any time. We will notify you of material changes via an in-app notice or by updating the "Last Updated" date above. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
2. Description of Service
Pawmony is an all-in-one pet care companion application that provides tools for managing your pets' health, care routines, and well-being. Features include, but are not limited to:
- Medication and vaccination tracking with reminders
- Personalized daily care checklists
- Walk mapping and GPS route recording
- AI-powered health insights and poison risk analysis
- Litter tracking and behavioral logging
- Sitter sharing with care profile access codes
- Nearby veterinarian, emergency clinic, and dog park discovery
- Play date community matching
- Lost & Found pet reporting
- Training session logging and streak tracking
- Nutrition logging and barcode scanning
- Memorial profiles for pets who have passed
We reserve the right to add, modify, suspend, or remove any feature at any time, with or without prior notice, at our sole discretion. We will make reasonable efforts to notify you of significant feature changes.
3. Eligibility
You must be at least 13 years of age (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that you meet this age requirement.
If you are between 13 and 18 years old (or 16 and 18 in the EEA), you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf and consents to your use of the App.
You represent that you have the legal capacity to enter into a binding agreement and that your use of the App does not violate any applicable laws or regulations in your jurisdiction.
The App is intended for personal, non-commercial use only unless you have entered into a separate written agreement with us for commercial use.
4. Account Registration and Security
To access certain features, you must create an account using Sign in with Apple, Google, or email/password. You may also use the App in a limited local mode without signing in.
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your login credentials confidential and secure
- Notify us immediately at support@mypawmony.com if you suspect unauthorized access
- Be solely responsible for all activity that occurs under your account
You may not create an account on behalf of another person without their express authorization. You may not create multiple accounts to circumvent limitations, bans, or suspensions.
5. Free Tier and Premium Subscription
Free Tier: Includes support for one (1) pet profile and access to core features including basic health tracking, medication reminders, and walk mapping. The free tier is provided at no cost and may include limitations on records, AI queries, or advanced features.
Premium Subscription: Unlocks unlimited pet profiles, advanced AI health insights, full walk history, sitter sharing, play dates, complete achievements, detailed health reports, poison analysis, and all other premium features. Premium is offered as a monthly subscription ($3.99/month) or annual subscription ($29.99/year), billed through the Apple App Store.
We reserve the right to change what is included in the Free Tier or Premium Subscription at any time. Existing subscribers will be notified at least 30 days before any material reduction in Premium features.
6. Subscription Billing and Cancellation
All subscription purchases are processed exclusively through the Apple App Store. By purchasing a subscription, you agree to Apple's App Store Terms of Service in addition to these Terms.
Billing: Your subscription payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
Cancellation: You may cancel your subscription at any time through your Apple ID account settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period. You retain access to Premium features until your current paid period ends.
Free Trials: If a free trial is offered, unused portions of any free trial are forfeited upon purchase of a subscription.
7. Refund Policy
All purchases and subscriptions are managed by Apple and subject to Apple's refund policy. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com or contact Apple Support.
If you believe you are entitled to a refund due to a technical issue on our part, please contact us at support@mypawmony.com.
8. Acceptable Use Policy
You agree to use the App only for lawful purposes. You agree not to:
- Use the App in any way that violates any applicable law or regulation
- Attempt to probe, scan, or test the vulnerability of the App or any related system
- Reverse engineer, decompile, or disassemble the App
- Use automated scripts, bots, or scrapers to access or collect data
- Upload or transmit viruses, malware, or any other malicious code
- Impersonate any person or entity or misrepresent your affiliation
- Upload false, misleading, or fraudulent information about yourself or your pets
- Use community features to harass, stalk, or harm other users
- Attempt to interfere with or disrupt the App's servers or networks
9. Pet Health and Safety Disclaimer
⚠️ Important
The App is not a substitute for professional veterinary advice, diagnosis, or treatment.
Always consult a licensed veterinarian:
- Before starting, stopping, or modifying any medication for your pet
- If your pet shows signs of illness, injury, or behavioral changes
- For all medical diagnoses and treatment decisions
- For guidance on nutrition, exercise, and preventive care
In any pet emergency, contact your veterinarian, a local emergency animal hospital, or the ASPCA Animal Poison Control Center (888-426-4435) immediately.
10. AI-Powered Features Disclaimer
The App includes AI-powered features including health insights, poison risk analysis (Poison Analysis / ChewCam), breed matchmaking, and discover search, powered by xAI's Grok API.
Critical Disclaimer — Poison Analysis
- Results may be incomplete, inaccurate, or fail to identify a hazard
- A "low risk" or "safe" result does NOT mean the substance is definitively safe
- If you believe your pet has been exposed to a toxic substance, contact a veterinarian immediately — do not rely solely on AI analysis
You assume all risk associated with acting on AI-generated content. We are not liable for any harm, injury, or loss resulting from reliance on AI-generated responses.
11. User-Generated Content
You retain ownership of all content you create. By using the App, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit your content solely to provide the App's services.
You agree not to upload content that is false, depicts animal abuse, infringes third-party rights, or is defamatory or harassing. You are responsible for the accuracy of all pet health information you enter, including medications and dosages.
12. Intellectual Property
The App and all its content are the exclusive property of Pawmony, protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal devices for personal, non-commercial pet care purposes.
You may not copy, modify, distribute, or create derivative works based on the App, or use our name, logo, or trademarks without prior written permission.
13. Privacy
Your use of the App is governed by our Privacy Policy, incorporated into these Terms by reference. By using the App, you consent to our collection, use, and disclosure of your information as described therein.
14. Third-Party Services
The App integrates Firebase (Google LLC), xAI Grok API, RevenueCat, Apple CloudKit, and Google Sign-In. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices, availability, or reliability of any third-party service.
15. Location Services
Walk tracking, nearby search, and geo-fence features require location access. Walk routes are recorded and stored when you start a walk session. Geo-fence alerts require continuous background location monitoring. You can revoke location access at any time in your device settings.
16. Camera, Photos, and Media
Poison Analysis images are transmitted to xAI's servers for analysis. You retain ownership of all photos you capture or upload. We are not responsible for the security of photos shared in community features accessible to other users.
17. Sitter Sharing Feature
You are solely responsible for choosing who you share your sitter access code with. Pawmony is not a sitter marketplace and does not vet or guarantee any sitter services. Any arrangement with a sitter is solely between you and that individual. We accept no liability for sitter performance or any incident involving a sitter you have engaged.
18. Play Dates and Community Features
By creating a play date profile, your pet's name, species, breed, and selected photo will be visible to nearby users. We strongly recommend meeting other users in public, well-populated areas. We are not responsible for any injury, loss, or harm arising from interactions arranged through community features.
19. Lost & Found Feature
By posting a Lost or Found report, information about the pet will be visible to nearby users. You agree to promptly remove or resolve any report that is no longer accurate. Pawmony does not guarantee the App will help reunite you with a lost pet.
20. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR APPROPRIATE FOR YOUR PET. YOU USE THE APP AT YOUR SOLE RISK.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWMONY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING HARM TO YOUR PET ARISING FROM RELIANCE ON ANY APP FEATURE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50.00).
22. Indemnification
You agree to defend, indemnify, and hold harmless Pawmony and its developers, affiliates, officers, agents, and licensors from any claims, liabilities, damages, or expenses arising from your violation of these Terms, your use of the App, your User Content, or any interaction with another user facilitated through the App's community features.
23. Termination
You may terminate your agreement by deleting your account (Settings → Privacy & Data → Delete Account) and uninstalling the App. We reserve the right to suspend or terminate your access at our sole discretion for conduct that violates these Terms. Upon termination, your license to use the App ceases immediately.
24. Dispute Resolution and Governing Law
Governing Law: These Terms are governed by the laws of the State of California, United States.
Informal Resolution: Before filing any formal legal claim, contact us at legal@mypawmony.com and attempt to resolve the dispute informally within 30 days.
Arbitration: If informal resolution fails, disputes shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Class Action Waiver: YOU AND PAWMONY AGREE THAT EACH MAY BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY REPRESENTATIVE PROCEEDING.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pawmony regarding the App.
